A couple sitting apart on a sofa after a disagreement

Family law

Family matters, handled with care.

When a family changes shape, the decisions that follow are best made calmly, by the people who will live with them.

Our approach

Divorce and separation do not have to be fought out in court. We sit both of you down with a neutral mediator, work through the home, the money and the children one issue at a time, and put what you agree in writing. Where agreement is not possible, we represent you in court.

Family law

What we handle.

  1. 01

    Divorce mediation

A structured, neutral process in which both spouses agree the terms of the divorce together: the home, the money and the children.

  2. 02

    Divorce settlement agreements

We draft the settlement agreement and prepare the papers, so an agreed divorce can go through court without a fight.

  3. 03

    Unopposed and contested divorce

Unopposed divorces under the Divorce Act 70 of 1979 when both spouses agree, and representation in defended divorces when they do not.

  4. 04

    Parenting plans, care and contact

Written plans for care, contact, schooling and decision-making, and disputes about where the children live, as provided for in the Children’s Act 38 of 2005.

  5. 05

    Spousal and child maintenance

Maintenance applications, and disputes over amounts, arrears and changes, under the Maintenance Act 99 of 1998.

  6. 06

    Customary and lobola marriages

Registration of customary marriages under the Recognition of Customary Marriages Act 120 of 1998, and disputes over lobola and customary unions.

  7. 07

    Antenuptial contracts

Advice on marital regimes before the wedding, and antenuptial contracts prepared for registration, so your choice is legally effective.

  8. 08

    Protection orders

Help with applications for protection orders under the Domestic Violence Act 116 of 1998, where mediation is not appropriate.

Mediation first

Why mediation works here.

We start at the table because, in these matters, it usually gives the better result.

  • The children come first

A parenting plan agreed by both parents is more likely to be followed than one imposed on them.

  • Less conflict, lower cost

Every issue settled at the table is one less issue argued, and paid for, in court.

  • Private by default

Mediation sessions are confidential. Your family’s affairs stay out of the courtroom.
